Terms of use

Kamon.net is a website administered by Roots Development Committee (herein referred to as the Company, we, us, our). The Terms of Use (herein referred to as the Agreement) are defined as follows.
Kamon.net is administered under the terms of the Agreement to provide services to all users (herein referred to as you, your) who seek said service. By using the services, you will be deemed to have agreed to the Agreement.
1. Application and variation of these terms
a. These terms are applicable to all services provided through Kamon.net
b. If we deem necessary, we may vary these terms at any time without notice to you. Any variation to these terms will be effective upon uploading to this webpage. You should refer to this webpage to view the most recent Agreement prior to using any service.

2. Personal Information
As per the Personal Information Protection Law, we have defined the following policy.
a. We will abide by the Personal Information Protection Law, and any related Regulations.
b. Any Personal Information we collect will only be used for the websites, kamon.net and myoji-yurai.net, and their respective Apps.
c. Unless otherwise specified under the applicable Laws or Regulations, we will not disclose your Personal Information to a third party without permission from you.

3. ID and Password
a. Your user ID and Password are your responsibility
b. We shall have no liability for any loss or damage arising from your failure to keep your user ID or Password secure, their misuse, or use by a third party.
c. If you suspect that your user ID or Password have been used by a third party, you must notify us immediately. You are to follow any instructions given by us.
d. If you disclose your user ID and Password to a third party without our consent, and if the third party gains unauthorised access, we will terminate your account and suspend all services to you.

4. Termination of your account
We will terminate your account and suspend all services to you under the following.
a. We have discovered that you have been terminated in the past; or
b. You are found to have been in breach of this Agreement

5. Provision of equipment
a. You will provide yourself with all equipment necessary to use our services through kamon.net. This will be at your own cost and responsibility.

6. Prohibited use and abuse
You agree to not engage in the following.
a. Interfere or disrupt any server or network that is associated with providing a service, or breaching the terms of use of said service
b. Breach any Law, judicial decision, orders or administrative rules
c. Engage in any conduct that is seen to be a public nuisance
d. Impersonate us or any third party, or intentionally mislead
e. Use our services for purposes other than the intended use. This includes, but is not limited to, use for commercial gain, for dating or for seeking relationships.
f. Support, financial or otherwise, any criminal organisation
g. Religious activities, or the recruitment for any religious organisation
h. Unauthorised collection, display or circulation of Personal Information
i. Interfere or disrupt our ability to provide our services, or for other users to access these services. This includes, but is not limited to: unauthorised access, faking IP addresses, sockpuppeting, libelling, or copyright infringing.
j. Unauthorised editing or deletion of our content
k. Support or encourage any of the activities listed above (a. – j.)
l. Any other action deemed unacceptable by us

7. Use of service
a. You understand and agree to bear any risk and responsibility, including any potential losses incurred, associated with using Kamon.net
b. We reserve the right to restrict your use of our services.
c. We shall have no liability for any of your content that is lost or deleted

8. Variations to services
We may vary the services provided from time to time, without notice to you. We shall have no liability arising from any variation to our services.

9. No liability
a. We shall have no liability for any loss or damages arising from your use of our services. This does not absolve us of any obligations under the Consumer Law if our services are deemed to be covered by that law.
b. Even in the case specified above, we do not assume any responsibility for damages to you due to any breach or negligence by us (excluding gross negligence). Any compensation for such damages will be limited to the monthly usage fee paid by you when the damages occurred.

10. Compensation
a. You will be held liable for the cost and responsibility of resolving any of the following events, or any associated claims or disputes
i. Your breach of the Agreement
ii. Any content sent or released by you through our service
iii. Your use of our service, and any associated actions
iv. Your breach of any third party’s rights
b. Any costs incurred by us in resolving any claims or disputes associated with the above will be borne by you. This includes any legal costs.
c. If you breach any rights of a third party, including but not limited to defamation, breach of privacy, copyright, etc., you will bear all costs and responsibility. We take no responsibility for any of your actions.

11. Links
Third parties may, from time to time, publish links to external websites which may be available on our services. We provide no guarantees on the safety or security of these links. You bear all responsibility for accessing any third party website or resources.

12. Property Rights
a. We retain all rights to all content that is published on our service. This includes any content sent by you.
b. All software that is associated with our service is protected by the relevant IP laws
c. All content published on our service is protected by copyright, IP, and design laws.

13. Safety
We strive to make our website safe and secure. However, we do not guarantee neither safety nor security.
a. Spam is strictly prohibited on our website
b. You are not permitted to collect other users’ contents or details. The use of automated data collectors (such as scrapers, or other robots), are not permitted without prior authorisation from us.
c. You are not permitted to engage in a pyramid scheme or a multi-layer marketing scheme
d. You are not permitted to upload any viruses, or other malicious code
e. You are not permitted to seek other user’s login credentials, or access their accounts
f. Bullying, threatening, and harassment are prohibited
g. You are not permitted to upload any content that contains: discrimination, threats, obscenity, inciting violence, nudity, or graphic violence.
h. You must consider age restrictions when developing or administering mature content
i. You must not use our website for illegal, misleading, malicious or discriminatory conduct.
j. You must not support or encourage the breaching of this Agreement or any of our policies.

14. Jurisdiction
Unless specified elsewhere, this Agreement is governed by and shall be construed in accordance with the laws of Japan. The parties submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of Tokyo.

15. Breach of Agreement
If you discover that any other user is in breach of this Agreement, please notify us.
